On August 10, I submitted my brief for the small claims case that I filed two years ago. There was never any hearing or trial regarding that case, because Valley View evicted me by stating I refused to sign a lease --- when, in reality, Valley View refused to sign a lease --- in November of 2010.
Then, Valley View told the judge in my small claims action that Valley View's eviction case against me precluded my small claims lawsuit because the issue of the $150 bonus was already decided in the eviction case.
But, it wasn't. There wasn't anything about the $150 bonus in the eviction case -- 10 SC 10255, 10 AP 3056 on appeal. They only referred to it by way of trying to humiliate me because of Becky's and Jason's "accidents". But, the bonus was not a legal issue in the eviction case.
Valley View sent me a letter back in September of 2010 --- after I filed my small claims suit --- stating that they had to send a bunch of guys into my apartment to "rip up" my carpet because of alleged "damage" by Becky and Jason. But, I passed the Section 8 inspection anyway, and nobody had to "rip" anything "up". I had never received any 5-day notice from FRED / Valley View about Becky or Jason. FRED was just creating documents to show in court.
Further, the eviction case should --- and probably will eventually --- be dismissed. An adult on the lease (my son, nineteen at the time) was never even named as a party, among other things. I feel sure that Valley View / FRED's eviction case against me will eventually be dismissed.
Meanwhile, though, I have no place to live. All my things are in storage lockers, except what I carry in bags that day. Becky and Jason also have no place to live. They are in a shed, and my son has to feed them and give them water each day. At least they are together now, in the same shed.
So, even though my brief is not so great, I really worked very long hours on it. It represents a major investment of my time --- which is why I have not posted here since April.
In addition to long hours of working on the brief, I have to find something to eat each day, and find a place to sleep each night, and sometimes try to get some things into and out of my storage lockers.
