10 SC 8182, filed August 27, 2010: dismissed from the circuit court pursuant to a motion for summary judgment in March of 2012. A little slow, right? I am the plaintiff in 8182.
10 SC 10255 --- eviction against me, by FRED: My appeal was dismissed in December of 2011. I filed a Petition for Review with the Supreme Court, and it wasn't even dismissed through the regular process. It didn't even go through the regular process for dismissal because of a technicality. (Appeal to the Wisconsin Supreme Court is not a right. You have to get permission. You ask for the permission by filing a Petition for Review. The Court only selects about a hundred to two hundred cases per year, out of the possibly two thousand Petitions for Review. But, my Petition didn't even make it to the selection procedure.)
I am the defendant in 10255.
I sued the landlord in August of 2010 in small claims court. The landlord filed eviction against me on November 1 of the same year.
No retaliation there, right?
Well, that's what Branch 16 of the Dane County Circuit Court, and District IV of the Wisconsin Court of Appeals says.
This probably all makes no sense. I'll be writing more about the story of what has happened so far, on some other pages of this website.
So, yes, the "Official Story" is that my defense and my small claims action are both frivolous, and I have nothing meritorious to say to the court.
But --- well, the Innocence Project has taught us that the official story isn't always correct.
